What are COBRA, Cal-COBRA, and HIPAA, and How do They Affect Me?
COBRA stands for Consolidated Omnibus Budget Reconciliation Act, and Cal-COBRA is simply California's version of the Federal COBRA Laws, with a few additions. HIPAA stands for Health Insurance Portability Accountability Act.
So, what do these acts and Laws regulate, and how do they affect you?
COBRA Rules and Regulations
COBRA is gap health insurance for use when you lose your current employer-sponsored health insurance. You must experience a “qualifying event” such as quitting your job, being laid off or retiring, or being fired; your work hours are reduced so you no longer qualify for employer sponsored coverage; you are divorced or legally separated; you become disabled or die; you become eligible for Medicare; or your child ages out of your health insurance plan.
COBRA health insurance coverage is usually extended up to 18 months or until you find other health insurance. Disability qualifies you for coverage for up to 29 months, and divorce or legal separation qualifies the spouse for up to 36 months of coverage.
Keep in mind that if your employer went out of business completely and is no longer offering any health insurance coverage to anyone, the COBRA rules no longer apply. Instead, HIPAA rules come into play which will be described shortly.
Cal-COBRA Rules and Regulations
Cal-COBRA follows the same rules and regulations as outlined above with certain additions. Cal-COBRA offers continued health insurance to employees of businesses with 2 to 19 employees.
The main benefit of enrolling in Cal-COBRA is that your coverage may be extended an additional 18 months for a total of 3 years, essentially doubling the amount of time you have to seek out new health insurance. You must pay insurance premiums for this extended coverage.
HIPAA Rules and Regulations
The HIPAA rules cover privacy of medical records first and foremost. Your medical records may not be released without your written consent or used in medical research without your consent. These privacy rules were put into effect to prevent your personally identifying information from falling into the hands of marketers such as drug companies, and to set very strict boundaries for employers and health insurance companies in handling private information such as your social security number, telephone number, address, age, and so on.
In addition to protecting your privacy, HIPAA rules also allow for continued health insurance coverage if you would qualify for COBRA benefits but the time limit has expired or your former employer went completely out of business. The HIPAA rules allow you to maintain continuous coverage (at a higher premium than would be charged if you had health insurance through an employer).
You may not be turned down for HIPAA benefits nor required to go through a waiting period before coverage. These benefits extend indefinitely as long as premiums continue to be paid.
If your employer or health insurance provider does not comply with HIPAA privacy rules, they may be subject to fines starting at $1,000 for each occurrence and expanding to $50,000 for continued violations. This is for each occurrence, and there are caps up to $1.5 million for repeat offenders. Your medical records should remain strictly private unless you release them or they are needed in your care.
Additional Useful Information Regarding COBRA, Cal-COBRA, and HIPAA
State Laws vary, so your rights under the COBRA rules or the HIPAA rules may vary slightly depending on where you live.
It is important to pay the COBRA premiums on time every month. If you do not choose to continue health care coverage when you move to a new employer or a new plan, you may be required to serve a waiting period before your new coverage can begin. Having continuous coverage through COBRA prevents this waiting period in most cases. Know that federal health insurance rules are due to change in 2010, so make sure you are aware of current Laws.
Your employer or plan administrator is required by Law to provide you with information on how to sign up for COBRA and Cal-COBRA. You must be notified within 10 days of the qualifying event described above. You have 60 days to elect to pay the higher premium and extend your coverage.
Under the federal COBRA rules, your premium will be 102 percent of the former full premium (both your contribution and your employer's contribution). Under Cal-COBRA rules, your premium will be 110 percent of the former full premium.
